Terms of Service

1. Introduction
Welcome to Malabar Pest Control. These Terms of Service (“Terms”) govern your use of our pest-control services (the “Services”) and any related contracts, agreements or work-orders you enter with us. By engaging our Services or making a booking, you agree to these Terms.

2. Services Provided
We provide pest control, termite treatments, rodent control, fumigation, preventive maintenance and related work at residential, commercial and industrial premises in the Dubai & UAE area. The specific scope of each job will be described in the service agreement or invoice.

3. Quotation and Acceptance

  • We will provide you with a quote or service-agreement document specifying the scope, price, schedule, and terms.
  • Your acceptance (by signature, email confirmation, or paying a deposit) will form the contract between you and Malabar Pest Control.
  • We reserve the right to refuse or cancel any job if we believe the site conditions or access are unsafe or unsuitable.

4. Access, Preparation & Cooperation

  • You agree to provide safe, reasonable access to the premises at the scheduled time.
  • You will follow our preparation instructions (e.g., clearing areas, storing food, relocating pets) so that our technicians can safely and effectively perform the Services.
  • If you fail to prepare the premises as required, we may charge for extra time or decline to proceed.

5. Prices, Payment & Invoices

  • All prices quoted exclude applicable VAT or other taxes, unless stated otherwise.
  • Payment terms will be set out in your service agreement or invoice; typically payment is due on completion of the work or per schedule if under a maintenance contract.
  • If payment is late, we may suspend future services and/or charge interest or collection costs.

6. Warranties & Limitations of Liability

  • We warrant that our Services will be carried out in a competent and professional manner consistent with industry standards.
  • Except as expressly provided, we make no other warranties (express or implied) regarding the effectiveness, duration or outcome of treatments.
  • Our liability for any claim (whether contract, tort or otherwise) shall be limited to the amount paid by you for the relevant Service. We shall not be liable for any indirect, consequential or incidental losses (e.g., business interruption, loss of profits, property damage beyond the Service area).
  • You acknowledge that pest-control involves factors outside our control (environmental conditions, infestation severity, reinfestation, customer’s ongoing maintenance) and results cannot be absolutely guaranteed.

7. Termination & Cancellation

  • Either party may cancel or terminate the contract in accordance with the terms specified in the service agreement.
  • If you cancel within the period set out in your agreement (if any), you may be liable for a cancellation fee or loss of deposit.
  • We may suspend or terminate Services if you breach these Terms, fail to make payment, or the site becomes unsafe or inaccessible.

8. Safety, Health & Environment

  • We use approved chemicals and follow safety protocols in accordance with UAE regulations (including the Dubai Municipality Pest Control standards).
  • You agree to follow any safety instructions we provide (e.g., ventilating rooms, relocating pets/children during treatment).
  • We are not responsible for conditions on your premises that pose hazards (e.g., asbestos, mould, structural defects) unless disclosed and agreed.

9. Intellectual Property
All materials we provide (e.g., quotes, treatment plans, reports) remain our intellectual property. You may use them for your internal purposes only, and may not reproduce or distribute them without our consent.

10. Data Protection & Privacy
We will process any personal data you provide in accordance with our Privacy Policy. By accepting these Terms you also consent to our collection, use and retention of your personal information for the purposes of delivering Services, billing, compliance and marketing (unless you opt out).

11. Changes to Terms
We may revise these Terms at any time. We will notify you of changes before they take effect. Your continued use of our Services after changes constitutes your acceptance of the revised Terms.

12. Governing Law & Dispute Resolution

  • These Terms and any service agreement shall be governed by the laws of the United Arab Emirates and the Emirate of Dubai.
  • Any dispute arising out of or related to these Terms or the Services shall first be referred to good-faith negotiations. If unresolved, the dispute shall be subject to arbitration or as agreed in the service agreement.

13. General Provisions

  • If any part of these Terms is held unenforceable, the remaining parts shall remain in full force and effect.
  • Our failure to enforce any right under these Terms shall not constitute a waiver of that right.
  • These Terms represent the entire agreement between you and us regarding the Services, and supersede any prior communications, proposals or agreements (unless expressly overridden in a signed service contract).
